Dispute Resolution

In addition to litigation, we often use alternative dispute resolution (ADR) techniques, which include:

  1. Advice, counsel and planning (some problems clients face can be solved with some limited legal research and analysis, followed-up with a recommended course of action. Many clients can solve problems quickly and without litigation, with the right legal advice provided after focused legal research and analysis).
  2. Mediation (some problems can be solved without extensive litigation, through “facilitative mediation” - a process where the adverse parties and their attorneys meet with a “mediator” to discuss possible settlement proposals)
  3. Arbitration (some problems are sent to an “arbitration” for decision. In arbitration, the parties submit their claims and defenses to an arbitrator (or sometimes a panel of arbitrators) for a decision on the factual and legal disputes, instead of a traditional judge and jury determination). Arbitration can arguably be less expensive than traditional litigation in some instances. However, it can eliminate traditional jury trial rights in many instances and it can also create additional problems and unanticipated legal complications for the unsuspecting at times, too.)
