      <description><![CDATA[In Farm Bureau Gen Ins Co of Michigan v Hore, unpublished opinion of the Court of Appeals, issued August, 20, 2020 (Docket No. 347918), the Michigan Court of Appeals considered an issue becoming more common with the increased use of delivery services such as Shipt, Uber Eats, DoorDash, Grubhub, Uber, Lyft, etc.  That issue being a business-use exclusion in many auto insurance policies. ]]></description>

      <title>Wrongful Death - Medical Malpractice - Negligence</title>
      <description><![CDATA[In this case, a rehabilitation patient suffered a respiratory emergency that resulted in his aspiration and eventual death. Subsequently, the personal representative of his estate brought an ordinary negligence action against a nurse and the care provider facility for not adhering to a standing order regarding aspirations. The issue before the court was whether the case sounded in medical malpractice or ordinary negligence.]]></description>

      <title>Personal Injury - Motor Vehicle Accident - No Fault Insurance - Dramshop Act</title>
      <description><![CDATA[In Borkowski v Niles, Unpublished Court of Appeals Case No. 72181 (Decided January 21, 2020) the plaintiff brought a claim under the Dramshop Act as well as a third party negligence claim following an automobile accident involving a drunk driver.  Prior to the accident, the at-fault driver had spent several hours at an American Legion Post where she consumed multiple alcoholic beverages. The plaintiff argued that the at-fault driver was visibly intoxicated when served at the American Legion Post thereby making the Post liable under the Dramshop Act for his injuries. The trial court disagreed and granted summary disposition in favor of the Post. The plaintiff appealed.]]></description>

      <description><![CDATA[Under current Michigan Law, for there to be a valid will there must be a 1) writing, 2) signature by the testator (person creating the will), and 3) attestation and signature by two witnesses.  MCL 700.2502(1).  A will that does not comply with the above requirements may still be valid as a holographic will if it is dated, and if the testator's signature and the document's material portions are in the testator's handwriting.       <title>No Fault Insurance – Personal Injury Law – Motor Vehicle Accidents</title>
      <description><![CDATA[In Asraeel v Farm Bureau Insurance Company, Unpublished Court of Appeals Case No. 344022 (Decided October 1, 2019) the plaintiff was a passenger in an automobile that was involved in an accident. As a result of the accident, he suffered a broken clavicle that required surgery to repair.  He was also off work for 6 weeks following the accident and testified that he had to alter his work habits and recreational activities as a result of the accident. Plaintiff subsequently brought claims for PIP benefits and uninsured/underinsured benefits against Farm Bureau, as well as claims against both drivers of the vehicles involved in the accident. Defendants filed motions for summary disposition arguing in part that the plaintiff did not suffer a threshold injury. ]]></description>

      <title>Probate Dispute – Estate Administration</title>
      <description><![CDATA[In re Seville Estate, divorced parents both sought appointment as personal representative (executor) of their daughter’s estate after their daughter was killed in a snowplow v. moped accident.  The parents did not get along and made numerous allegations against each other trying to prove to the court why the other party was unqualified to serve as their daughter’s personal representative. Following a hearing on the issue, the probate court found both parties were unsuited in their individual capacity to serve as personal representative so the court ordered the appointment of both parents as co-personal representatives. The mother appealed the decision.]]></description>
