A builder was sued by a property owner, who claimed that the builder had not completed work he was asked to do. However, the property owner had interfered with the progress of the project by constantly adding on new tasks and also refusing to pay bills as they came due, making it impossible for the builder to move forward with the project any further. The Firm assisted the builder in defending himself, by filing an answer, affirmative defenses, and counterclaim against the property owner to ensure that a just outcome would be obtained.

The Firm represented a condominium association, and assisted the association with revising condominium bylaws to address short-term rentals, per the condo board’s preferences for new rules to regulate short-term rentals.

A Grand Traverse Bay waterfront property owner was unfortunately sued by a neighboring property owner, who raised a variety of allegations, including flooding of her parcel allegedly caused by the client or his property. The neighbor aggressively litigated, seeking injunctive relief and money damages from the client under a number of legal and equitable theories. The Firm defended the client in court and staved off any injunctive or damage relief being granted to the neighbor whatsoever. The case was eventually settled in facilitative mediation, which can be a good and productive process to resolve disputes.

Building a home can be an exciting time for a family. However, it can also be difficult and filled with stress. This is especially true if the family has to deal with an unscrupulous builder, or a builder who fails to deliver the promised goods and services to construct the home properly. The firm recently assisted homeowners with recovering a large sum of money paid to a builder, who failed to deliver the promised work after receiving the homeowners’ money. The firm filed suit for the homeowners, and they received appropriate repayment of their funds.
