No-Fault Insurance - Accident Law - Business Use Exclusion

In Farm Bureau Gen Ins Co of Michigan v Hore, unpublished opinion of the Court of Appeals, issued August, 20, 2020 (Docket No. 347918), the Michigan Court of Appeals considered an issue becoming more common with the increased use of delivery services such as Shipt, Uber Eats, DoorDash, Grubhub, Uber, Lyft, etc.  That issue being a business-use exclusion in many auto insurance policies.  As illustrated by the aforementioned Hore case, the business-use exclusion generally excludes insurance liability arising out of the ownership or operation of a vehicle while it is being used to carry persons or property for a fee. In short, this means that if you are involved in a car while delivering groceries for a service like Shipt, your auto insurance carrier may not have a duty to defend you from a lawsuit.  To be safe, if you are carrying persons or property for a fee, you should contact your insurance agent regarding purchasing commercial auto insurance.
